Should i fight a improper p on my motorcycle?

I was coming on to the highway. The lane for people entering from the onramp turns into the exit lane for the off ramp. So an SUV starts merging into my lane and I she didnt see me because I was almost pushed outta the lane. So I accelarated pasther not more than 60mph and got pulled over by a cop for "ping in the same lane as another vehicle."
